Shapiro, Appleton & Washburn Secures $1.6 Million Jury Verdict for Client in Medical Malpractice and Traumatic Brain Injury Case

The case originates from a missed diagnosis and negligent medical care. In 2017, the firm’s client presented before an attending physician in the emergency room at Sentara Leigh Hospital with nausea and abdominal pain. The attending ordered a blood test and computed tomography (CT) scan, which was negative. The client’s medical record reflected no ultimate diagnosis, and the physician provided instructions for the client to follow up with her primary care physician and a gastroenterologist for the pain.

Unfortunately, the client was suffering from low-moderate hyponatremia, a medical condition caused by abnormally low sodium in the body. The blood test ordered flagged the client’s low sodium, but no medical intervention was taken. The life-threatening risks of untreated hyponatremia manifested for 11 days after discharge until the client was discovered neurologically unconscious on the floor of their kitchen after suffering a seizure. This seizure resulted in a head injury, concussion, and traumatic brain injury, which was treated alongside the hyponatremia over several days at Sentara Norfolk General Hospital.

As a result, the client sought damages for medical malpractice and her traumatic brain injury (TBI), as evidenced by a subdural hematoma, intraparenchymal bleed, and three to the five-millimeter shift of the brain from the right to the side of the skull. The eight-trial involved more than a dozen expert witnesses. The jury deliberated for just over eight hours before returning its $1.6 million verdicts for the firm’s client.
